By accessing or using InciSister ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and InciSister. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

InciSister is a free web-based tool that provides ingredient analysis for cosmetic products. Our Service allows you to:

• Analyze cosmetic product ingredient lists
• Receive personalized safety ratings based on your profile (skin type, concerns, pregnancy status, etc.)
• Access information about individual ingredients
• Scan QR codes or upload images of ingredient lists

The Service is provided "as is" and is subject to change, modification, or discontinuation at any time without notice.

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, are the exclusive property of InciSister and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include:

• Any resale or commercial use of the Service
• Collection and use of any product listings or descriptions
• Derivative use of the Service or its contents
• Use of data mining, robots, or similar data gathering tools

Our ingredient analysis and safety ratings are not intended to be, and should not be construed as, medical advice, diagnosis, or treatment. No Warranty: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of any information provided

Accuracy Disclaimer: While we strive to provide accurate and up-to-date information, we cannot guarantee the accuracy, completeness, or timeliness of all information. Ingredient safety research is ongoing, and recommendations may change over time.

To the fullest extent permitted by applicable law, InciSister, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from any products or services obtained through the Service
• Damages resulting from unauthorized access to or alteration of your data

Our total liability to you for all claims arising from or related to the use of the Service shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim, or $100, whichever is greater. Since InciSister is free, this effectively means our liability is limited to $100.

You agree to indemnify, defend, and hold harmless InciSister, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Service caused damage to a third party

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may discontinue using the Service at any time by simply ceasing to access it.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which InciSister operates, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
